It wouldn't bother me. The state inspection is for tires, lights and brakes. Two outta three you can check easily. I'd inspect the brakes when I serviced the bearings, which is one of the first things I do on a used trailer.
I use Mystik JT-6 High Temp No. 2 grease. Its in a red tube. I chose it because it is on Dexter's approved grease list, is easy to find, and less expensive than the other popular red grease. I just took a look. It's temp rating is to 325.
